Is this case from the US? A lot of details don't track what I know about US universities (after 40 years as a professor at one). My guess is Canada.

In the US, it is formally illegal to take into sccount race, sex, religion, etc for employment decisions, unless competing candidates are otherwise equally qualified. DEI outrages can sometimes be stopped by reporting (or threatening to report) them to the uni's general counsel's office. I know personally profs qwho have successfully used this strategy at a large flagship state U in Texas.
